Abhaya: Bail granted to three accused  

Kochi, Thursday, January 01, 2009: The Kerala High Court has granted conditional bail to all three accused Father Jose Putarika, Father Thomas Kottor and Sister Seffi in the Abhaya murder case. High Court Justice Hema also ruled that the existing CBI team, which is investigating the case, would continue to probe the case. Also a senior officer should monitor the investigation justice ruled. The bail has been granted after detailed hearing.
Father Thomas Kottur, Father Jose Puthrikayil and Sister Sephi were directed by Justice K Hema to furnish a bail bond of Rs one lakh each and two solvent sureties for the like amount.

The accused have been asked not to make or receive any telephone calls. If calls are made or received, their bail would be cancelled, the court held.

The three will not leave the residence without permission from the Magistrate, who should also be informed about the details of their residence, the court said.

Justice Hema also directed the accused to cooperate in the investigation and to appear before the investigating officers as and when required.

“The petitioners also should not influence or intimidate any witness or tamper with evidence,” the court held.

The CBI moved a fresh affidavit in court regarding the interference of KCBC and Kottayam diocese in the probe. CBI requested the court that the statements of the diocese are hampering the probe.
Earlier, Sister Abhaya’s father had petitioned the ‘Church Janajagrata Samithi’ and the Kottayam diocese for making verbal attacks against the CBI the petitioner had alleged that the Kerala Catholic Bishops’ Council (KCBC) decried the efforts of the CBI.
The petitioner also contended that such remarks would amount to interference in the course of justice.

The three accused were arrested Nov 19 by a CBI team - the 13th after 12 earlier teams failed to crack the case. While Putarika is a former Malayalam professor at the Kottayam College where Abhaya studied, Kottor is the Diocesan chancellor of the Catholic Church at Kottayam and sister Seffi was a resident of the convent when the incident took place.

    Thats the end to justice…. these culprits can never be punished, I pity the parents of sr.Abhaya. Our judiciary system has to change. People with money & influence can get away scot free… this proves it.

    Justice HEMA,finally you got these three out, for time being. Kottayam diocese, what was Justice HEMA charge you,for this wonderful service,how many CRORES ? NOW,the lifes of these three are in real danger, better they seek police protection, stay away from convents.As the Kottayam Diocese or KCBC will go to any extent to safeguard the image of this sect, may make it look like suicide,these same MAFIA will latter announce these three Devils- Sr. Seffi as Saint Seffi,Saint Kottor & Saint Putarika. Catholics just watch, the fun starts now. We can all light candles, attend novenas etc.

    Watch out! Peter Paul, in the event anything DOES happen to any of the accused while they are on bail, the people of this forum now know exactly who to direct the CBI to. Your explicit threats against three won’t do you much good at your narco analysis.

    Wahy all this cry.It is only Bail.Even Manichan got Bail.So did so many others.I am confident that Justice will prevail.After all these 3 were scot free for a decade and a half.

    If nothing else they will be drowned forever in their own sin.
    The KCBC has been an allout pain and shame to the very people they represent.I am yet to hear of any God who take sides ever with any criminal.
    May the justice prevail.
    Talking against the court at this juncture will only jeopardise the already murky judicial process that the Kerala Millions have been watching all these years- not only in this case but in many other cases.
    Justrice delayed is also justice denied.And this is a matter of undertrials only.

    The first three commentators are real stupids. They are stupdid horrible than our CBI officers. I thought those CBI officers are the first idiots who are living in Kerala since they arrested three innocent people with out evidence. The first three could join in the CBI.
