HC doubts foul play by CBI and Dr Malini

Kochi, Wednesday, July 15, 2009: Raising doubts over the role played by the investigation agency and the former Forensic Science Laboratory Assistant Director Dr Malini in the Sister Abhaya murder case, Kerala High Court Jude while granting relaxation in the bail conditions of Jose Poothrukkayil, she said both had plotted to derail investigation.

Justice said, the conclusion made by her earlier that the CDs containing the narco analysis results were doctored have now proved to be true.

Also the narco analysis questions and answers were messed up. Justice Hema said, the refusal of CBI that it won’t challenge Justice Ramkumar rule in Apex Court and Dr Malini’s involvement, which was pointed out by her, and was challenged by CBI also strengthens doubt.

Considering the bail condition of Jose Poothrukkayil, Justice Hema said, he may be allowed to go outside the state after informing the Ernakulam Chief Judicial Magistrate.

The Kerala High Court Judge Justice Hema had granted conditional bail to the three accused Fr. Thomas Kuttoor, Fr. Jose Poothrakkayil and Sr. Sephy in the Sister Abhaya murder case, on January 1.

Justice K Hema ordered the accused not to leave the place where they resided without the permission of the magistrate court.

The accused have been asked not to use any telephone until further orders. In case they made or received any phone calls, the bail was liable to be cancelled.

The court directed them to pay two solvent sureties of Rs 1 lakh each and surrender their passports. They were also been asked not to indulge in any act whatsoever to influence or intimidate any witness or tamper with evidence.
