Custodial death: Hold the charge sheet, says HC  

Kochi, Friday, May 21, 2010: has revoked the submission of Crime Branch charge sheet detailing the investigation on Sambath’s custodial death in Palakkad. Sambath is the prime accused in the Puhtur Sheela murder case. High Court has ordered to revoke the submission of charge sheet on account of the petition filed by Sambath’s brother Murukesh.

The Court would take its final decision over the matter whether the case must be handed over to the CBI or not. The Court observed that the Police force had to agree that Sambath was murdered by the police brutality and that the police SP was also involved in the custodial death. Court also examined that the police had failed to arrest the culprits involved in the murder.

The State government in an explanation to the High Court had informed that there was no need for a CBI probe in the custodial death of Sampath, the prime accused in Puthur Sheela murder. The police investigation was progressing in the right direction and therefore a CBI probe at this stage was not necessary in the case, the explanation said.
