HC declines to stay single judge’s order on lottery   HC


Kochi, Thursday, September 02, 2010: The Kerala High court today declined to stay a single judge’s direction restraining the draw of other state lotteries. A Division bench, comprising Justice Thothathil B Radhakrishnan and Justice P Bhavadasan, however, asked the government to receive the advance tax for one draw of Bhutan and Sikkim lotteries.

The order was issued on a writ appeal by Megha Distributors, promoters of Sikkim and Bhutan lotteries. Senior Supreme court advocate Nageshwar Rao, representing the government, informed the court that the state would file an appeal tomorrow challenging the direction to receive advance tax from the appellant.

The case has been posted to Tuesday.

On August 30, Justice P R Ramachandran Nair of the High Court had directed the state Government to accept advance tax from Megha Distributors, promoters and agents of Sikkkim and Bhutan lotteries, for selling lottery tickets in Kerala.
