Kodikkunil files appeal in SC challenging HC order  

Thiruvananthapuram, Saturday, 07 August 2010: Kodikkunnil Suresh has filed an appeal in Supreme Court today, challenging Kerala High Court’s order nullifying his election to Lok Sabha on grounds that he was not entitled to contest from a reserved constituency. The five-time MP of Congress from Mavelikkara constituency has filed the plea in SC, through Congress leader and Senior Advocate Abhisek Singvi.

Suresh has pointed out in his plea that Pulaya, Cheramar categories came under Scheduled Caste and hence the High Court’s order making his election void was against rules.

High Court had annulled election of Suresh in a significant verdict pronounced on 26th of July. The Court, however, had later stayed its order for three weeks time. The stay was granted subject to the condition that Suresh shall not participate in the voting in the Lok Sabha or meetings in the Parliamentary Committees. And that he shall not claim any salary or any other allowances.

In a noteworthy verdict made on July 26th , High Court nullified election of Kodikkunnil Suresh of Congress to Lok Sabha, from Mavelikkara constituency.

The Court in its ruling, told that Suresh, a Christian convert and five-time MP, who now represents Mavelikara (Reserved) constituency, was not qualified to represent the constituency.

Justice Sasidharan Nambiar pronounced the verdict on three appeals filed by the defeated CPI candidate from the constituency R.S Anil and two others.

The Court verified the caste certificate produced by Suresh and observed it unreliable and fake, and that was not adequate to prove his right to contest from a reserved constituency. It also pointed out that his statements recorded at different times conveyed contradiction and hence ruled out stating it deceitful.
