New Delhi, Monday, August 31, 2009: The writ petition moved by CPM state secretary Pinarayi Vijayan challenging Kerala Governor RS Gavai’s decision to prosecute him the SNC Lavalin scam and to nullify the charge sheet filed by CBI against him was accepted by the Apex Court today.

The court refused a stay on Governor RS Gavai’s decision. Pinarayi Vijayan’s counsel Fali Sam Nariman did not seek a stay on Governor RS Gavai’s order.

Since there is no stay on Governor’s order, Pinarayi Vijayan and other accused have to appear at CBI special court on September 24.

The Court also allowed Thalasserry based ‘People’s Council for Civil Rights ‘led by Advocate Asif Ali and TP Nandakumar crime magazine editor to join the petition.

The Court also decided to send summons to CBI and state government.
