Kochi, Monday, January 12, 2009: While considering another case today Justice Hema who granted bail to all three accused in the Sister Abhaya murder case said, only the Apex Court can have a final say on lower Court orders. Other justices are not entitled to make observations on Court orders.

Justice K Hema who was the center of the storm after she granted bail to two Catholic priests Thomas M Kottoor, Jose Puthrukakyil and Sister Seffy added that her judgment was based on going through with the case diary.
After going through the Case Diary and examining the materials placed by CBI, had observed that “the investigation is going off the track, and had derailed.” Further detention of the three accused — Father Thomas Kottur, Father Jose Puthrikayil and Sister Sephi, on the basis of materials placed, would result in gross ‘miscarriage of justice’, the court held while allowing their bail pleas.

    Justice Hema
    Judiciary can not be activated actively. It is only a Watch dog.
    THE Justices and their judgements are defaming the justice system of India. Judges are jokers eg Dinakaran of Bangalore high court
