Sohrabuddin case: CBI likely to submit report in SC  

Ahmedabad, Friday 30 July 2010: CBI is likely to submit its report on the probe into Sohrabuddin Sheikh fake encounter killing case of Gujarat in the Supreme Court Friday.

While transferring the 2005 episode to CBI in January this year, the Supreme Court had asked it to file a report within six months of starting investigations into the high-profile case in which former Gujarat Minister Amit Shah and four IPS officers are among the accused.

The agency filed a fresh FIR on February 1 in Mumbai and commenced investigations by recording the statements of witnesses and collected evidence from Gujarat CID, which was handling the case earlier.

With the apex court-fixed deadline coming to an end on July 31, CBI officials are busy giving final touches to the report, which is likely to be submitted in the next couple of days, they said.

The investigation agency has arrested three accused, Shah, IPS officer Abhay Chudasama and one Rajendra Jirawala, in whose farmhouse Sohrabuddin and his wife Kausarbi were allegedly kept before being killed. The earlier arrests were made by the state CID.

Today, CBI questioned Inspector K M Waghela, who was with Gujarat ATS when the fake encounter had taken place near here in November 2005. The apex court, while transferring the case to CBI, had slammed the Gujarat police and some officials for not carrying out the investigation in a proper manner.

The SC had asked CBI to probe the “larger conspiracy” behind the entire episode, which also involved murder of Sohrabuddin’s wife Kauserbi and subsequent encounter killing of Tulsi Prajapati, a key witness.

The apex court had further said there were various discrepancies in the probe carried out by the Gujarat police and the chargesheet filed by it. The SC had come down heavily on the state police for attempting to “mislead” it by filing conflicting action taken reports (ATRs).
